So far, most of the warranty phones I've seen has come with the recent update unfortunately. You may get lucky though. Just keep a watchful eye on it when you boot it. The updates are automatic of sorts and will start when you least expect it.
I was going to say the exact opposite. Every Warranty (Assurion anyway) I have seen lately has the older update on it. Exactly what happened to me.
