The International Trade Commission is back in the news in the ongoing cases of Apple vs. Motorola, and it is now targeting Apple!

The ITC voted to open an investigation against Apple for patent infringement, which was filed by Motorola. Motorola has told the ITC that there are seven patents that most of Apple's devices are infringing. These devices include the iPhone 3GS, iPhone 4, iPhone 4S, iPod touch, and all models of the iPad.

Now some might ask "Why isn't the iPhone 5 on that list?"; Well, if the iPhone 5 had been officially announced before the filing took place, it too would be on the list. But the request was already filed by Motorola at the time of the announcement, which boots the iPhone 5 off the list.

Besides the majority of Apple's mobile life, Motorola is also going after Apple's IM knockoff iMessage, which allows Motorola to add the Mac Pro, iMac, Mac Mini, MacBook Pro, and the MacBook Air to the list. So this means that most likely Motorola's goal is to ban the import of all 12 of these devices.

It would be a huge blow to Apple if Motorola does win this case, so if this one does go to court, you know we will be all over it.

Great read. Now days with all the law suites, 2 things have become apparent. Its really anyone's game if you can back you accusations up well enough and 2 is I need to become a lawyer lol

I just really wish we could get past this litigation stage. At least put it on Judge Joe Brown or Judge Judy so I can laugh

I would guess one of them being something along the lines of some type of Wi-Fi?

I'm not a fan of apple at all. The limits that they place on their products make parts practically proprietary and therefore over priced because they can. While that's good for business, it's bad for consumers. Especially IT savy/IT pro cosumers. It amazes me how little apple users/fanboys actually know about their own systems compared to users of other brands and OS. I'm not saying that everyone needs to know how to fix a system, but it is night and day. An easy example was in my previous company, the original founder sold the company to a new guy who decided that he wanted to start pushing macs to our clients. He came in and couldn't figure out how to install a printer onto his new iMac. Seriously? I hadn't touched a mac since the mid 1990s in high school, but was still able to set it up in a few minutes. So this guy came from a major communications company as an IT admin, and couldn't even install a printer on a mac!

Needless to say I do not own a single apple product. Love the new GS3 commercials. My feeling on this case is that Motorola probably actually does have a decent case against apple. However, as we saw with the previous case vs. Samsung, Motorola will not get a fair shake in the US. It's not because the people who own macs will be upset, because they do not have a large enough share of the computer market to matter. The iPhone side of the business, however, is another story. I won't say it's too big to fail, but I would say that it's too popular for a fair legal process. I'm guessing this won't go too much further. Apple will settle for a large amount, not have to pull any products and keep on chugging along. The only way to make Apple come back down to earth is the old fashioned way. Have to beat them in the open market by consistently building superior products (which apparently need to be painfully easy to use) that outsell Apple until they are no longer top dogs. Then, maybe, will you see more of the shortcuts and cut corners that apple actually takes. Then will be the only time that something like this law suit would stand a chance in the US. Any other country would push this case right on through. America the land of opportunity? Not for the smartphone market.

I agree with the previous post. Another dynamic that may work against Motorola here is the perception of them as a foreign company suing an American company. Even though we know that's hogwash, popular, superficially reinforced, opinion can be dangerous when misdirected.

Didn't fully read everything (there's 7 patents in question) but the main one discussed was how iMessages are handled. There's a chance that any Apple device with iMessage on it can be banned, including Macs.

iMessage, Siri, and notifications are infringing for starters. iMessage is the most serious as it would ban the import of nearly all current Apple products.

How exactly does iMessage infringe? Do our phones have a similar messaging system?


From what I understand, and I could be very wrong considering patents are written as confusing as possible:

Moto's patent basically allows you to intiate a conversation from one device, through a messaging server, and a second device can access that messaging server, receive those messages and relevant data, and to allow it to continue the conversation. And of course with iMessage (and frankly a lot of things) you can start the message thread from a Mac, and then continue it on your iPhone.
