I really don't like not having a flash player is there anything I can do to get around this?

and download the latest flash player for 4.0 which is v11.1.115.20 it seems to work for me. It may not work perfect and sometimes you will have to exit the browser when things start acting up and try it again but overall it works good for me. I had v11.1.115.17 and just downloaded the new one so not to sure how well this one will work. Just tried streaming some stuff and it worked. i noticed that v11.1.115.17 didn't work with any other browser but the stock one. Will be testing with other browsers shortly.

Make sure it's enabled in the browser settings. Works fine for me.
